Separation, divorce and arrangements for children are some of the hardest things to go through. Getting the right advice early usually makes them shorter and cheaper.

If it's urgent

If you or your children are in danger, call 999. Courts can grant emergency protection orders quickly, and a family solicitor can often apply the same day.

Who you need

A family solicitor. Many are also trained mediators or collaborative lawyers, which can keep a dispute out of court.

What to do first

  1. In England & Wales you'll usually need to attend a Mediation Information and Assessment Meeting (MIAM) before applying to court about children or money, unless an exemption applies — domestic abuse is one.
  2. Gather financial documents early: payslips, bank statements, pension details and mortgage paperwork.
  3. Keep communication with your ex calm and in writing where you can. Messages can end up in front of a judge.
  4. Legal aid for family cases is limited, but is often available where there is evidence of domestic abuse. Check before assuming you have to pay.

Divorce in England & Wales has been 'no-fault' since April 2022 and usually takes at least 26 weeks from application to final order.

Questions worth asking any lawyer

  • What will this cost — fixed fee, hourly rate, or a share of any compensation?
  • Who will actually do the work, and how often will I hear from you?
  • Have you handled cases like mine, and what's a realistic outcome?
  • Could I get this done for free through legal aid, insurance or a charity?
